Warranty assesment

On 12 March 2013 I renewed my cell phone contract (cell number 083 560 4987) with the MTN store in greenstone mall, and received Blackberry 9790. In May my wife noticed that the touchpad was sticking whenever she tried using the phone and this persisted for a few weeks. We even tried removing the battery to reset the phone, but this did not help. We subsequently went to the Stoneridge MTN store on 1 June 2013 to get them to send the phone in for assessment. The consultant that helped us was Juan. I explained to him what the problem was and that the phone was less than 3 months old. He mentioned that we need to send the phone in for assessment. He subsequently printed out the forms and got me to fill them in. At no stage did he mention that we could send it in as a warranty assessment. On 11 June I went to fetch my phone and when the consultant (a black gentlemen) gave me the phone I noticed that the IMEI number was not the same. The consultant did not even know that, as he was shocked that it was different. I expressed that I was not happy to accept a refurbished phone, as my phone was virtually brand new, and I did not know the history of this phone. I should get a new phone.
