C Cell swop phones to meet repair deadlines

My phone was drop off 3 months ago at cell c gateway Durban. When I picked up my phone from ashna (manager) I found out it is re-furbished phone. I was told that my phone could not be repaired, and received a call from a manager from cell c - viven marimuthoo from 084 167 1089 claiming to be from head office, and he could not give me a the reason why I received a used phone with someone else's contacts still on the phone and why I could not get my phone fixed. He said it was because of the time lapsed at the repair centre. I took the replacement phone and returned it to c-cell and complained to cell c ('Mashudu Mufamadi' )she assisted me from customer care, but to this day I have not received my phone or a new replacement phone. Seems like MR VIven who represents C CELL, is a law unto himself. Is this (the replacing of my cell, with someone else's) I am still paying a cell c contract. Shouldn't I be given a new phone with a new warranty if my phone could not be replaced and not be given someone's junk.
