Vodacom cancellation fee of 75% of the remaining contract fee is NOT fair and reasonable.
Whilst the CPA does not describe reasonable or a fixed fee, it does not take very much to realise that 75% is not reasonable or fair.
The following arguments can be made, taking into account the CPA:
1. The general practice of the relevant industry is not considered by Vodacom when determining the reasonable cancellation charge or penalty
2.The CPA further clearly states that the cancellation charge may not have the effect of negating the consumer's right to cancel a fixed term agreement.
In law, reasonable has the following meaning: just, rational, appropriate, ordinary or usual in the circumstances
Vodacom time and again denies that their cancellation fee is unreasonable and we as consumers need assistance in this regard
