ADSL Speed Problems

I had a 384Kbps (48KB download) service for many years, then I upgraded to Fast DSL (4Mbps), I did this 18 months ago. Since then I have paid for the service but it is so erratic. Telkom have been in and out checking and testing. I just can get the speeds associated with 4Mb which should be around 500KB download. I got excited one morning when I saw 200KB around six am, it was short lived.
I have just done a speed test (Used Mweb's Speed Test Link, 19 May 2013 11am) my upload speed 0.37Mbps was better than the download speed 0.32Mbps. I ran this after I received a follow up call from Telkom to ask if the ADSL was running faster now as they had just come to check and test after a placed a call. How does one get what one pays for, or a refund?
