Not returning deposit

A deposit was paid on a new property, the buy being subject to bond approval from bank. The bank did not approve the bond, which was on the 13th Oct 2012. In November 2012 I asked for the deposit back, as per our offer to purchase contract.
After numerous emails and phone calls and empty promises, I am still waiting for my money.
