My daughter bought a flat, 1st time owner, whilst a tenant is leasing the flat. It was never disclosed Hannah Joubert Properties managed the flat& the lease was between previous owner &HJP. Once the property was registered in her name, HJP continued managing, without her knowledge &also taking commission. On offer to purchase it was noted that she can take occupation on transfer. In suspended conditions it was also noted that she was aware of the lease in place& what the terms &conditions were. However nowhere was it stipulated what the terms &conditions were&now they using this clause to prevent her from taking occupation &insist they have the right to management contract. She is in a dilemma of paying a bond &rent. HJP is delaying getting the tenant out&insisting, should she want to take over management of her flat, she needs to pay a non management fee of 6% of the rent for remaining months of lease. Its strange 1 must pay a fee to get out of a contract 1 never signed. Would u want to Purchase or even rent from an agency who is just interested in taking money¬ thepurchaser.
