In Feb 2013, I signed a lease with Pam Golding Kloof St for Studio 5 at Six on Pepper. Upon signing the lease the agent noted that the apartment could be noisy on the weekend, but never fully disclosed the severity of the noise coming from the nightclub downstairs. Noise levels far exceed residential standards, and not only on the weekend but weekdays as well. Post signing, I was informed that previous tenants who had complained were physically intimidated by the owners of the club. When I informed PG and the owner of my intention to terminate the lease on beneficial occupation rights and entering a lease without full disclosure, I was refused. I referred the matter to the housing tribunal. The City Of Cape Town has agreed to test the noise levels, but the owner is refusing access. The agent was advised to relet by the owner in UK. Please be warned. The agent has not been forthcoming on queries regarding re-advertising and re-letting of the apartment, the written mandate from the owner, the retention of my deposit in a trust account until the matter is settled or contact details for the principal member and their legal counsel
