Refusal to cancel contract on due date and taking advantage of an elderly woman

Good day

I am acting on behalf of my mom - please see the attached consent my mom is giving me to act on her behalf, and I would appreciate the quick response to this matter.

Short summary of situation: I called some time ago to cancel the contract, they said I can only cancel it one month prior to the original contract date, which is 4 December 2023. Today is one month and one day prior to original contract date.

My mom is almost 83 years old, and her mind and memory is not what it used to be, and she cannot manage anything on her own anymore. During October, maybe late September, someone from Vodacom called her to upgrade, and even without my mom realizing it, the contract was upgraded and a phone was delivered to her. It was never accepted, and the old age home where my mom is staying kept it in their safe. I called to cancel the upgrade early in October, and they said they could only if they arranged to pick up the new phone. It was all set to collect the phone, but was never done. Only yesterday Karen at the old age home let me know that the phone was never collected.

My mom is not using the full content of the contract, and she cannot afford it anymore, so that the reason for the cancelation, and it was never meant to upgrade as we need to cancel the contract today, latest tomorrow as it is one month from contract end date without paying any fees for the cancelation. I am doing this within the time I need to, so the cancellation should be done as Vodacom made the mistake of not collecting the phone which was not supposed to be delivered and upgraded.

Seeing that it is Vodacom's mistake for not collecting the phone, I expect Vodacom to collect the phone from Karen at reception, as was arranged a long time ago, but was never done by Vodacom, and cancel the contract within time not to accumulate any fees.

Please do listen to the voice recordings of me talking to Vodacom requesting cancellation of upgrade, the voice recording of my mom telling them to cancel the upgrade, as well as telling them to collect the phone.

I expect feedback from you asap in writing, and to cancel this contract with the upgrade WITHOUT ANY COSTS, as it was not our fault, but on Vodacom's side.
