Damaged Goods, refuses responsibility

Booked my warrantied television in for service with Samsung, Samsung then booked it with dynamic cooling and the television was damaged. It's been since November 11th and I still don't have my television back, not to mention that the owner of dynamic cooling (the company Samsung booked the TV into) said the company is poor and does not have the cash to replace the damaged television and won't take responsibility of his company's negligence.
