Registration number of car: We never received one.
Order number: We never received any order number nor any contract and nothing was discussed with us prior as she stipulated that the car was in perfect running order as per advised.
vehicle identification number (VIN) of the vehicle was never given to us neither.

On 18 September 2022 , I bought a Red Mini Cooper 1.6 from you at a cost of R45 000 which I paid in cash via EFT into a non business account and no tax number has been provided nor company registration number, and into a personal account of Capitec.
The Consumer Rights Act 2015 requires you to supply me with goods that are of satisfactory quality. The car is not of satisfactory quality for the reasons given below.

THE CAR IS DEFECTIVE AND THE FAULT (S) IS (ARE) LISTED BELOW:
FAULTS ON E.C.U

1. Airbag indication light on
2. Flat tyre indication light on
3. Disc brakes are so worn hand brake cannot be set, on maximum set point.
4. Driver side seat belt sensor needs to be replaced and seat leaver is broken.
Both front seats are broken.
5. All the above mentioned needs to be corrected for engine light to be reset and be in working order again.
6. The vehicle is not road worthy and they refuse to roadworthy or to license the vehicle and they had stipulated that the vehicle would be the very next day and at the same time that they would be licensing the vehicle that I had just purchased. Then they would be couriering all documentation the very next day. Non of this was ever done,.

CLUTCH AND GEARBOX

- Gearbox making a loud humming sound when in 4th & 5th gear
A. - Gearbox will not select 1st or 3rd gear at all after many attempts to have this fixed and by
a mechanic.
B. Clutch pedal dropping to the floor because off faulty slave & master cylinder leaking though
we had the slave & master cylinders replaced we did notify you of this the same day of purchase and promised me that your partner would be in contact with us to make

FRONT & REAR WHEELS & SUSPENSION

1. Front rim has a dent on the inside & not the same rims as in advertisement nor tyres. They actually swopped out the tyres that was advertised to really bad tyres and rims.
2. Front & rear bearings need to be replaced, making a bad noise as u drive and it’s clearly damaged.
3. Left & Right inner & outer cv boots are broken
4. Left & right ball joints need to be replaced
5. All rubbers mountings on rear suspension arms are badly worn, bad knocking sound
from rear of car, now this is advertised as a perfect running vehicle.

FRONT BUMPER & PLASTIC BODY TRIMMINGS, BONNET, REAR WIPER

1. Front bumper mounting clips all broken off, front bumper was hanging with wire.

2. All plastic moulding trimmings loose & broken 3.Bonnet not closing, due to the car being in a car accident that has also not been discussed with us before hand. It was told to us that the car was never been in an accident.
4.Rearwindscreenarmandwiperblademissingcompletely. Thattoowaspromisedtous.

ELECTRIC WINDOWS

1. Divers side window not working motor burnt out & fuse blown. So my window doesn’t close.

JACK & SPARE WHEEL

A. 1. No jack

This too was promised to us, that very Tuesday.
I have obtained a second opinion in support of my claim that the car has a serious fault,
the 'Used motor vehicle - consumer rights' guide gives more information, regarding this matter and I am requesting a full refund and to note that the vehicle after almost 3 months of begging you for my car’s license that was promised to be delivered within 48 hour’s and it’s still not registered on my name. So therefore the vehicle still belongs to you. I am prepared to go public with this matter and to the Ombudsman.
I have been very patient with you, and I have given you more than enough time to respond and to sort this matter out.
Cost price must also clearly show additional fees such as VAT, on the road fees, licensing etc. consumers the Act requires that products including 2nd hand vehicles available for sale must be of good quality, in good working order and have no defects.
1.)The legislation further endorses the issues of safety by providing for a mandatory warranty of six months which allows a consumer to return a product should it fail to perform or gets faulty within the six months period after delivery to a consumer

I did some research and found it odd that a business that has been running since 2013 had not a single comment or review or business pages or website, and runs his Facebook account as a group so he remains completely in control so nobody can actually complain or report them or drop a review regarding there purchase.. Auto dealer fraud is a big concern in a car purchase. Car dealerships advertise their vehicles at a desirable purchase price but sell them-at higher prices, advertise cars that they don’t actually sell, or used car dealers advertise their cars as having no damage when they actually have defects, advertise cars that they don’t actually sell, or used car dealers advertise their cars as having no damage when they actually have defects. Failure to Disclose – It is considered false advertising if a company fails to disclose a material fact about a product. Businesses cannot make fake claims about a product’s price, purpose, or quality. When a company or car salesman engages in false advertisement, it’s considered auto dealer fraud, and they can face sanctions and be potentially sued. Victims of fraudulent advertising are entitled to injunctive relief and compensation of damages. Dealers must display an accurate CIN on used vehicles. The CIN shows important information about the vehicle, including: vehicle details – the year first registered, make, model, vehicle identification number (VIN), chassis number, odometer reading, vehicle registration details and if it was imported if there is money owing on the car the dealer’s name, address and registration number the cash price – including GST, registration and licensing costs information about your consumer rights on the back of the card, including where to go if you have problems. NONE OF THE FOLLOWING WAS DISCLOSED TO US AND I REPORTED THAT THE GEARBOX WAS HOMEMADE AND WAS BROKEN AND I LITERALLY JUST MADE IT HOME AND GEARBOX PACKED UP. This all was reported within 12 hours of purchasing the vehicle. It’s been almost 3 months I still have no license No paperwork No customer support or feedback Ignore my call and messages Bought a car to which is not mine at the end of the day and I don’t even know if the engine number is the one that goes with the vehicle and the didn’t have 200 000 it has 327 000 And I literally just made it home and the car packed up. In fact placed mine and my girls lives at risk as the engine blots was not even in. And the bumper is attached with a piece of wire. And all homemade jipose!!! This is illegal.
2.) A consumer who has bought a 2nd hand vehicle that exhibits defects within a period of 6 months of buying it, has a right in terms of the CPA to return the vehicle to the dealership for repair or replacement of faulty components or a refund of money paid for the vehicle.
3.) The supplier is then expected, at the discretion of the consumer to either replace, repair or refund the monies paid for the vehicle.
The Consumer Protection Act No 68 of 2008 (CPA):
Now things have changed as the CPA states that an official car dealer may NOT now sell a
vehicle, new or second hand, “ VOETSTOOTS” or “as is”, irrespective of whether they disclose what’s wrong with it or not.
A full list of all known defects has to be provided to the buyer by the seller. You as the buyer would then in the sale agreement have to sign and acknowledge the presence of those
defects.
If any defects are discovered with six (6) months of the sale you have the right to insist on repair, replacement or a refund. This is your choice as the buyer. The dealer has no choice in the matter.

KEY & ALARM UNIT
A. 1. Key provided not working to activate or deactivate alarm unit of the vehicle purchased. B. 2. No spare key was provided for the vehicle purchased

alarm keep going off randomly when activated.
PAPERWORK of the vehicle was never delivered to us nor Service book as advertised,
Till now we have received nothing, no paperwork whatsoever was ever received. NOTHING
I have been unable to make use of the car since purchasing it and received no joy from the dealer and I would like a full refund and I have an invoice from the mechanic for work that has been done so far. I am open to suggestions, for the compensation.
