Credit card retained and duplicated

While waiting for some business to be completed by my bank, I decided to pass time by having lunch. The server was extremely friendly, engaging, and in retrospect perhaps overly attentive. I didn't think much of it because locals are sometimes taken aback that I look like them but sound "American." Again, as I was paying the bill, she talked incessantly. Later when I realized my card was missing, I hurried back to Parrots. She immediately knew why I was there, and gave me a story about accidentally putting it in her apron/pocket or something like that and said she had turned it over to her mgr for safe keeping. About a month later, I noticed transactions made overseas that put me in arrears. I had not traveled and this card, one I seldom ever use, was intact. The only other recent time I used it was at a self-service machine at Brooklyn theater, so I feel very confident that the breach occurred with the lady and/or her mgr. When I phoned the restaurant to report my suspicion, the manager (Derek?) didn't seem very interested. When I persisted, he took my details and said his supervisor would phone me, but to date no one has. I'm considering filing a police report.
