I have an ongoing case against a previous employer. Once the matter got to the Bargaining Council LTS provided a lawyer however as the matter was not settled we are now preparing to take this to the Labour Court however LTS claims that this is not covered in terms of the policy (there is no specific reference to the LC in the actual policy, i was referred to a broad clause under Exclusions "appeals/reviews").
In terms of my monthly premiums i am insured for R109, 000 per claim and as this is an ongoing matter find it difficult to understand why covered has been withdrawn. This is a perfect example of an unforeseen circumstance when this type of a policy comes in handy. I have had this policy for about 15 years now and if i had been made aware of the limitations i would definitely have moved to a competitor years ago!
After liaising with the claims manager (LTS) Chantelle de Venter, i was told that this is the end regarding this matter and they do not have any policy that covers such a situation. As per my understanding taking a matter to the LC is due process and LTS policy cover is seriously flawed, i wonder how many innocent clients are not privy to this vital information
