I'm currently in debt review and my cheque account overdraft was part of the debts to be paid. I have never defaulted on my account. All along the payments were made correctly but around February 2010 my cheque account was not paid anymore. I made inquiries with my debt counsellors (Debt Busters) but was told that the account was settled. When I check my account on the internet banking there was an outstanding balance on the account and tried to bring this to Debt Busters attention but they insisted that it paid up.
I then when to the bank to ask if the account if settled in order to get a clearance certificate but was told again that the account have an outstanding balance. Debt Busters continued to disregard this account when making payments to all my debtors. The account was eventually taken out of the debt review despite all the complaints I lodge with debt busters.
I managed to settle this account but FNB has already handed this account to the legal firm and now they want me to pay about R10k.
Since this is not a mistake on my part, can I make Debt Busters responsible for this debt?
