Failure to recover my excess from third party

Claim no: 88811238. A male from Worcester bumped into my right back door during October last year-2012. The Total cost of the repairs was R 4485, 46. Outsurance told me that the excess is R3210, 00. After paying this excess out of my pocket and in CASH, I was promised that Outsurance will recover this amount from the third party. The door was eventually fixed and I received the car back in December 2012. They got hold of the third party In January 2013 and an agreement was made with the third party that he would pay R500 back per month. According to my calculations he should have been finish paying and I should have gotten my excess of R3210, 00 back by now. Jathin Mathura from Outsurance said I must call them during the second half of 2013 and they will then pay my excess back. I try to phone him several times during the first two weeks of October 2013, He is either out of office or not available. When I sent another email from several emails to him, I got a response from him that I should call the legal department for this recorvery. Another lady from Outsurance also called me but she could only tell me that the third party already paid the full amount. When can I get my money back?
