VIOLATION OF SECTION 86 (5) OF THE NATIONAL CREDIT

I am flabbergasted at ABSA Bank's determination to frustrate the debt review process. They are clearly in violation of Section 86 (5) of the National Credit Act 34 of 2005. I have been trying to obtain a COB from them since 29 August for our one of our mutual clients. I tried reasoning with Musa who was most incompetent and insisted that 'ABSA Bank's records showed that the client is married in community of property' and that my 'client must go into a branch and update his records despite the fact that I verified his marital status on the Department of Home Affairs website which I copied to them on an e-mail and I also provided ABSA Bank with a copy of the client's divorce decree and identity document yesterday. I also pointed out that, whilst I understood that it will make business sense and it will certainly be good admin practice for ABSA Bank to endeavour to keep their clients information updated, that their admin processes cannot supersede the National Credit Act! There is certainly nothing preventing ABSA Bank from contacting their client and requesting him to call at a branch to update his information and providing me with the COB to enable me to undertake my evaluation.
