Lapsed claim

I was the third party in a paint accidne which resulted in my car being covered in white enamel paint. I lodged a claim. The claim however was not paid out as they did not receive the release form. despite having issued me with a settlement form thencompany now refuses to pay out the claim as they say it has lapsed.
