Not Paying Claims

I sent my Motorcycle back to the dealer as I was having problems.
While it was in the posession of the dealer (The dealer sent it to a third party appointed by the dealer). The motorbike was after being handed over to the third party. The motorbike was damaged beyond economical repair and as a result is to be written off. We sent a letter of demand to the Dealer who submitted it to their insurers ETANA who after almost 8 WEEKS and 2 months installments eventually get back to us and say they are not going to pay out.
THE MOTORBIKE WAS NOT IN MY POSESSION
THE DEALER SENT IT TO THE THIRD PARTY (WHO I DONT EVEN KNOW)
IT WAS NOT MY FAULT
WHY SHOULD I END UP WITH THE PROBLEM???
