Locked in so much for CPA

After changing jobs, and my contract due for upgrade, I decided to downscale. I had the iPhone 4 which I was very happy with. I went to the Vodacare Cresta outlet to enquire. To the consultant Thomas I made it very clear that I was looking to downscale, but also would prefer the iPhone 5. However I made it very clear that I did not want to change anything if there was a pay in. I was encouraged to take the Samsung SIII and off I went.

On 27 December I was debited with R1500 penalty fees. After various calls I am none the wiser, and at this point would like to leave Vodacom althogether. I am having no joy, and the phone is acting up already 3 months later. Reference Number: SH421-1MLGM for calls logged.

The facts are: (1) I would not have upgraded if I knew there was a penalty. (2) Passing the buck is really not on. (3) I refuse to be victim to a phone repair process 3 months in.

I want a refund and my all my contracts cancelled. You are welcome to collect your handsets.
