New Samsung S4 takes more than 1 month for battery

I took an pen ended contract out on 2.7.2013. After using the phone for 3 months the battery would go from fully charged to completely flat within minutes. I need my phone for work so this was a problem. I took it in to be fixed and was told they will send it away for 14 days. The consultant opened the phone and noticed the battery was swollen. I took it in on 17.10.2013 and today have not got it back. I called them on 13.10.2013 only to be told the phone had been there for a couple of days. I went to pick it up to find my screen had been replaced and no battery with it. I was told they would over night me one but have not heard anything from them yet. I now find out that because this was done, my 24 month Samsung warrenty is invalid. And also that they should have offered me a 6 month warrenty assessment. I havent been able to even use the data because i have a micro sim and only the new phones take it. So i am paying for a broken phone i don't have and data/airtime i can't even use.
