Paying but no phone

On Sunday I went to Westgate to get a 2rd contract phone, Which i received but on Monday, i release that the phone was not working properly Blackberry 9720, it was so so slow en freezing. i went back to Westgate en reported the matter and asked the guy who was helped with the contract if i can cancelled the contract he told me i can't, he said they will have to assess the phone then he will get back to me. I haven't used their starter pack even the phone. Last night they deducted the money from my account. How can one pay for the phone she doesnt have en never used the sim card...!
