Hi my name is Reyur. I'm looking for advice on my current situation as I am not sure how the law covers me and what my options are.
My dad's cell contract was upgraded with Nashua Mobile last year in around the month of August. I was told when I picked my phone up in October 2012 almost a month after the upgrade took place, because of delays on their part, that my phone had a 7 day in-box guarantee and any problem thereafter faced will not be on Nashua's liability. Two months later I noticed the "A" key was troublesome.
A year has gone now and the phone has accumulated its common defects as listed by many expert websites. I now decided that my phone needed repairs. I took it to Nashua Mobile recently, where to my surprise they say the phone was under guarantee and will be sent for assessment. If deemed it's a manufacturer defect my phone will be serviced or if not cost efficient I will be given a refurbished handset.
My question is, am I allowed to ask for a new device because I can't wait for a phone and I do not want a serviced one or refurbished unit.
doesn't the consumer protection act protect me on this situation. I'm aware of people getting new devices why am I different?
