Who is responsible?

In March 2013 I went into MTN vangate to apply for a new contract for a modem for my husband. I previously had a contract for a data package & a cellular phone which I gave to my daughter. The consultant who assisted me realized that I was due for an upgrade& upgraded the data package when I got home I realized I made a mistake, so the following day I returned the package as she gave it me & asked her to cancel the transaction. She told me that her manager said "I cant just return things as the device was opened" also bearing in mind that the store open's the device to check that everything is working. Eventually I resorted to calling MTN 3 days after taking the device & they did a conference call with her & she was told to return the device, she told me then she would give me a new contract along with the device. End of June the 1st modem's contract was due & of course I called MTN to find out what the story is & the consultant upgraded & gave me a new contract which was the reason I initially took back the device, to avoid having 2 contracts & she didnt even bother to explain to me that this would be the issue. I tried meeting with her manager on 2 occasions but he dismissed me.
