MY 6-wk old Blackberry stopped holding charge and I returned it to Cellucity and they insisted it had to go to Vodacom for "assessment" or repair. I've done some research and it appears that according to CPA there is an implied 6 month warranty and one of its provisions is that I can ask for a replacement phone although Vodacom has the right also to make sure it's not customer damage. My issue is that b) why was I told no, when I said I'd prefer a new phone; b) Cellucity tell me that they're just the middle man so it's not their "problem" and c) the Vodacom repair form tells me I've agreed to terms and conditions which are NOT printed anywhere on the form!
