Sony phone upgrade, now second time ooo, want new

I upgraded in March 2013, phone second time in for repairs. insist on new (not SONY) phone, or else to end Nashua contract. They don't want to assist me. I just want to supply me with 'n new phone - definately not a SONY. I upgraded two months ago, but have not had a phone, eversince
