On the 11th January 2012 we (R Viljoen & SJ Pretorius) signed a contract for 84 Eaglewood Mooikloof Ridge
Pretoria that would be in effect from 1 March 2012 until 29 Feb 2013 According to par 4.2 of the contract, the tenant has an option to extend the lease for a futher period of 12 months to renew by giving written notice TO THE LANDLORD ON OR BEFORE 1st Jan 2013 On March 2013 we received an email from Smile Properties with a renewal contract Th covering letter was dated 30 Nov 12 and the contract signed on 1 Jan 13 which was a public holiday and that makes me suspect the contract is backdated Why only forward contract to me on 11 March 13? Note that the LANDLORD was not given notice by the 1st Jan 13 and this is already breach of contract At that stage property was already in market and the 2 months notice period was applicable On the 2nd May 2013 we gave notice We usualy receive a mothly rental fee of R5420.50 but this month only R1611 When inquired they mentioned they retain 50% as result of early termination and additional costs for loss of commission They have no right to keep money back as we gave 2 months notice Smile Properties refuse to give me a final statement
