Payment of Refund on Defective Car not received!

During the course of September 2013 we purchased a BMW 320i from the Edenvale Branch (we traded in our rover for the BMW). The car had supposedly been taken to BMW for a complete inspection and the report came back clear. After taking delivery of the car it started to make a funny sound near the left tyre. We returned the car to Ian who took it to BMW. BMW advised that there had been work done to the car and as a result the motorplan had lapsed. Ian said that he would try to source another car for us, to the extent that he cannot replace the car he would refund us. Ian was not able to replace the car and accordingly we arranged for a refund. To our surprise we were informed that the refund would not include the value of the trade in and instead Imperial would return the car and refund us the cash paid. On receipt of this news I informed Ian that we reserve our rights in relation to the Rover and will only accept the car in the same condition as we traded it in. Ian advised that payment of the refund would be made by 26 November 2013. We have still not received payment and the Rover is not in the same condition. Edenvale is not taking any responsibility since Ian and Leon have left.
