We had a Birthday Party dinner at this restaurant. When the bill was presented a 10% surcharge was added for service. Nothing was written on the menu, no poster was on a wall saying that would happen and the Manager admitted that there was nothing to warn patrons that they would be automatically charged the additional 10%.
I give a tip at my discretion not because I am forced to do so. Because their computer defaults to adding 10% does not mean I have to pay it.
In this case I was subjected to two acts. The one had to do with the representation and assurance of a food item on the menu. The second had to do with this 10% which was charged without my agreement and against my will. I also believe that it deprived the waiter of a genuine tip.
