MISLEADING CLIENTS

My vehicle had been bumped from the back on the right hand side at a red robot with heavy traffic at a busy intersection. The driver of the company vehicle admitted he was wrong. I took down all his details and the company's details. I submitted all the information to my Insurance. They said they would get back to me as there was a 3 day waiting period, on the 4th day I had not received any update I had to call them. I was told that I would pay an excess amount of R5500 and it would be refunded to when the invoice would be sent to the third party. I followed up once again yesterday and I was told that there is no guarantee that my excess amount would be refunded back to me as the driver can turn around and say he was not at fault when the evidence is there, I was utterly shocked by this. Which made me question then"What the h.ll do I pay my insurance for, if there is no guarantee. Why did they not inform me about this from the beginning when I took out my insurance. I have never missed a payment ever since I got my vehicle and this is how they treat a client. I am suppose to feel secured with my insurance but I dont. Any advise on what I can do in the meantime? I'll appreciate it
