I divorced my ex-husband in 2009, where in the court settlement we agreed that he would keep the house, & the debts incurred. In 2011 I started getting calls from the bank's attorneys that the house had been repossessed, & there was an amount still owing. I explained to the lady that called that I had nothing to do with the house as I'd been divorced for years, & the property was awarded to my ex-husband, & all the debts were taken over by him, so we didn't share ownership of anything. The lady informed me that my name was never removed from the bond, however I can fax them a copy of the divorce settlement. I then went to court to request the divorce file which as per court clerk could not be found, I called the lady back, & she told me to fax an affidavit done by my ex stating that he had sole responsibility of the debts, which he did. I faxed the affidavit, & also gave her his contact details. She contacted him & called me back to inform me that he agreed that he was solely responsible for the debt & was making arrangements to settle the account. Yet today a judgement has been made on my name, & not on his name, this has impacted negatively on my life, it's frustrating :-(
