Cell phone claim

I registered a claim for my cell phone that fell out of my pocket while going up the stairs and my cell phone broke in 4 different pieces. My claims consultant Shimone van de Merwe refused to entertain my claim and said the reason behind this is that this is due to bad workmanship when the cell phone was repaired, which I feel has nothing to do with my claim. Yes the phone was repaired by my brother who gave the cell phone to me as a gift and the phone was working perfectly fine, until it fell and broke. Why must insurance companies like Miway always look for things not to payout a claim even if you honest. My claims consultant even e mailed me a form to sign that was sent to my service provider to confirm when last the phone was used, which is ridiculous as if I am lying. Miway your service is pathetic and I am not going to leave it here.
