I am surety on a bond. The surety ship on this bond should have been removed/changed to one of the directors of the company in whose name the bond is. This should have been done at latest in 2010 when I have a mail from the directors of the company to ABSA requesting change of debtor on this bond. This did not occur.
The directors did attempt to do this, as can be seen from their mail, (sent to ABSA in 2010 and again more recently as proof) however it seems that this was not followed through on from the bank, and my name is still on this bond which is incorrect. I was alerted to the fact that this still had not been done when the bond went into arrears, and have spent the last 2 months trying to find the person in ABSA who 'has a mandate to remove the surety ship'. I am still waiting...
I have been sent from collections to the branch, where I was put in the enquiry queue and then referred to a consultant who phoned homeloans, and then referred me to another branch. The Randburg branch is 'following up' but they have been following up for a couple of weeks there too. Surely one definite appointment and the correct /forms signatories should suffice?
