Quality Vacation Club (qvc)
Refusal to accept termination of contract

We notified QVC of the termination of our contract and requested a settlement amount. We received no response and QVC continued to process debit orders against our account although we instructed them repeatedly to stop doing so. We reversed the debit orders each time. After 4 months we suddenly received a response from QVC's representative informing us that we could not terminate the contract, as it was not a fixed term contract in terms of the Consumer Protection Act and that it was governed by the NCA. She also "advised" us not to reverse the debit orders as we would be listed as slow payers with the credit bureaus. She failed to mention that the NCA also allows the termination of contracts. Section 122 allows a consumer to terminate a credit agreement at any time by paying the settlement amount to the credit provider. The settlement amount is the unpaid balance of the principal debt, plus any unpaid interest and other fees/charges payable to the credit provider at the date of settlement (which will in this case include part of the management fee). We informed QVC that we would publish this complaint and also pursue the matter through the appropriate channels.
