Phone from shop refuse responsibility

Early January 2013. New phone taken in, no BBM. Systems down. went back later.(system was on but went off again). Left the phone there and went for a meal. On his way out the manager said that they will not be responsible for, this was weird since they take phones for repairs daily and there were quite a few phone on the back counter.. Went back later, the lady said it was fixed but could not find it. Went back the next day and was told it must have been. She said she will try to claim from insurance. Phoned regularly for progress. She told me that they will try to replace the phone with a new repaired phone. Phoned her last week and was told they still don't have a replacement phone, and that the manager said that he told us that if it was that they will not be responsible. I asked to speak to the manager but he was not in. I requested him to phone me back with no response. I also logged a complaint on the Nashua mobile website with no response. Reasonable care should have been taken. Please replace phone or nullify contract. Thanks
