5 weeks after return of goods STILL NO REFUND

On MOnday 3rd December I bought a brand new iPhone 3 from the Northgate Vodacom branch for R3000 cash (no contract as they no longer sold that model, this was one of excess stock). After a week I returned it on Monday 10th December because the screen would sometimes freeze when I received incoming calls and the phone would turn off randomly. The person who sold me the phone also received the returned product and confirmed it was in perfect condition to return.
He said it would take up to 7 days for the Out of Box Failure to be verified and then I'd be refunded.
5 weeks later, I'm still waiting.
On Thursday 10th January he phoned me to say that Vodacom was now saying the phone had been scratched - a blatant because he confirmed with me on return of the product that it was in perfect condition.

I am still R3000 out of pocket as Vodacom take an unacceptably long time to resolve this issue.
However, I challenge anyone to be 5 minutes late with your phone bill and they'll terminate your service.
UNACCEPTABLE. And of course - what can I do against this telecoms giant?
Essentially, Vodacom have R3000 from me - perhaps I should open a case with the police about this.
