Out of Box failure becomes a repairs case tactical

I took an iPhone 5 on contract at Cell C Sandton City on 14 Dec, 2012. Within the week the camera stopped working. Camera started working intermittently and then the lock button at the top of the phone stopped working.

I went to the store several times to raise this and was assured that this constitutes an out of box failure and that the handset would be replaced once stock arrived. Days turned into weeks into months.

I have a trail of emails between myself and the store as well as Cell C Customer Service and monthly follow ups. After your first 10 visits to the store, you somewhat feel ridiculed making the effort to physically go to a store to be turned away with pitiful excuse.

I was assured that this would be remedied. Now I am told that the phone would have to be sent for repairs which could take up to 21days to be assessed/repaired & no loan phone will be given & if a loan phone is given it will be an ordinary phone.

The iPhone takes a differnt sim to other phones but how does an Out of Box Failure become a repair case & me without phone or stuck with a damaged phone
