Gearbox & Alarm Unit problem

Gearbox problem:
I bought my BMW 330i from Hatfield BMW with - 60000km, aprox 2 years ago. Since then, the car was in the workshop numerous times for the gearbox problem gearing down sporadically very harshly. The upgraded the gearbox software, engine software, replaced oil, even earlier this year disabled the Soft-stop feature (totally unrelated). Every time I call them, they want me to bring in the car, but if I take it in every time, I will never have my car, because it will be at BMW the whole time. Now that they don't know how to fix the problem, now they consider the matter as resolved, even though the gearbox is still doing exactly the same as when I bought the car. - Gearbox should have been replaced long ago.
Alarm Unit:
In the past 1.5 years, the car cannot stand for more than 3 days, without being jump-started. I reported the problem numerous times. The Menlyn branch service manager said its my tracking unit. I replaced it. Car did exactly the same. 5000km out of motorplan, the car didn't start after 1 day. The had to replace alarm unit and car's battery which was damaged as a result. Now they didn't want to refund me from motorplan, even though it was reported several times.
