Smart Clutch needs to be replaced

My Smart car was taken in to McCarthy's Witbank on the 27th December 2012, for not selecting reverse, I was told that this is not a known problem and they needs to log this with head office. I went on to the Internet and found a lot of similar complains that the clutch was substandard o the models between 2008 and 2011, my car is a 2010 model, the car has 40 000Km on the clock, after a week I was informed that it is the clutch and they do need to order it, and that Mercedes will cover half of the cost, fine for that, but this is an automatic clutch so it cannot be that the clutch was abused by the driver of the car, I have sent mails to Smart SA to enquire about this problem but till today I did not received any feedback from them. I still can not see why I need to pay half the money of a clutch that was sub standard from the beginning. It is th 8th February 2013 and McCarthy's still waiting for spares.
