I bought a Citroen Belingo in supposedly "excellent condition" voetstoots from Nissan Cape Town. I acknowledged I was buying the car as is but asked, many times, about any mechanical problems. I was told the heat gauge does go up but comes down again and that this "was nothing to worry about". I accepted this and paid cash. Two short trips and the heat gauge went up but came down, if I did not travel over 70 km/hr. Three days later, the car had no power as I struggled up a gentle incline in 2nd gear, the heat gauge shot up and an emergency warning light forced me to stop and cool the car down. Nissan refused to discuss the matter. I called Citroen Cape Town for help and a Citroen specialist immediately said he knew about the car and its problem because Nissan had sought his help. He had not been able to determine the problem. In a voetstoots sale of a vehicle, the seller is obliged to disclose any major mechanical problems. Despite numerous enquiries about the mechanical soundness of the car, Nissan Cape Town, although fully aware of the problems, failed to disclose this critical information. This is not only breach of contract but also. What recourse is available to me?
