On 22 February 2013 I applied electronically for a loan via Loan Discovery SA. On the same day i received an "URGENT" SMS requesting an deposit of R399 into their banking account. I ignored the message as I did not wish to subscribe to their telephonic legal advise service and I did not qualify for a loan. On 1st March they deducted R399 from my bank account. I immediately sent an SMS requesting a refund. The response was that I cancelled outside of the 7 day cooling off period. I referred them to the Consumer Protection Act which is clear about the calculation of the cooling off period. I was told that the CPA does not apply to them as they fall under the Electronic Communications & Transactions Act.as they do not provide goods only a service. This is utter rubbish. It is clear that the CPA applies to them (I have gone through the act with a fine tooth comb). I demand the refund that I am legally entitled to.
