M&F Trying to make poor pay for client neglegence

On April 30th 2013 a Mr. Johan Janse Van Vuuren collided into the back of my vehicle a 98 Citigolf. He stated his insurance would cover everything. We had to tow and recover my vehicle which amounted to R7500. We then waited 10 weeks for an assessor to come out and assess my vehicle only to have to wait another month almost to be offered a pathetic settlement. They offered us R12500 for the damage so minus my R7500 I spent on towing and storage I wound have R5000 to fix my vehicle with. This is absolutely unacceptable and I will not accept their offer, I was not the guilty party and M&F should restore my vehicle to what it was prior to their clients negligence, whether or not they think it is uneconomical to repair or not is of no consequence, they should make restitution for my loss.
Repairs to my vehicle were quoted at R29300 and R7500 towing, this amounts to an amount of R36800 which they chose to ignore and arrogantly said they will defend their client in court should we proceed with legal action subsequently saying I must bear a loss or R31800.
They expect those who they think cannot defend themselves to absorb the loss due to their clients stupidity.
