In response to my previous report, this has happened so far. The matter went before the small claims court 5 times. The small claims procedure is too difficult for some commissioners to preside over, that is for another time. On the 4th occasion a request was made for the assessor to be in court. The commissioner was competent in understanding the contents of the claim and also advised the defendant to inform MiWay to pay the claim otherwise. Alas on the fifth occasion the assessor is in court and the incompetent commissioner rules that the case is too complex and technical and would have to be heard in a magistrates court. The incompetence of people in areas of justice, service delivery etc. in this country beggars belief and has become the norm. The matter will now be handed to the ombudsman.
MiWay should consider my points of argument and respond accordingly. The assessors report says:(a) The brakes are satisfactory.(b) The damage is not incident related.(c) The damage is an existing one.(d) They have clear indications that the damaged part has been tampered with. All of this without a physical inspection or test drive. Truly amazing for MiWay and their assessor. Validate or pay up. J. Naidu
