MiWay
Unfair claim payment

My car was hijacked on 16 April 2013. I reported this to MiWay who initialized a claim. The assessor visited me at home and took down my details and obtained a copy of my logbook. At this meeting he declared that my car was a 2009 model and I will be paid out accordingly. On 8 May 2013 I received a call from MiWay and was told that my claim was processed and they were ready to pay me out. However, they stated that according to Toyota SA my car was a 2008 model and therefore the payout I received was much less.

On my logbook it states that the car was first registered in January 2009 which, according to the Toyota dealer where I purchased the car, makes it a 2009 model. Also on the Toyota dealer's computer database it states that my car was a 2009 model. I have tried to contact the assessor to inform him of this via phone calls, MiWay's help desk, and through e-mails but as yet have received no reply. Should I be penalized for the car being manufactured in 2008? The assessor said they were not going to do that but yet it happened.

Further sometime in the last year my excess increased from R2000 to R3000. I was not made aware of this and only found out when I was making my claim.
