Loss of pictures after an upgrade

My name isLydia, I took my black berry 9810 to vadacom repair shop @ cresta mall on 02/04/2013 as it was faulty, freezing and muting problems. I talked to Moses who's a technichian, I told him that i had very important pictures on my berry that i would not like to lose and he assured me that he was gonna do a backup (at R50) before sending my cell for a software upgrade. I was still worried and decided to consult the shop manager who confirmed the same thing as moses. So I Paid for the back up and left. I went back to collect my phone on Friday 05/05/2013 and to my dissapointment my pictures were not there. Both moses and the manager did not take responsibility, they said they are not able to get my pictures. i find it hard to believe and i told them that all i wanted was my pictures. They both promised to do what they can to get me my pictures back. I waited for them to call me and all in vein. I decided to call Moses on 08/04/2013 9.15 am and he confirmed that another technician was coming to help by the name of Professor an he was gonna call me back within an hour with the findings. Its 10/04/2013 at 5.41 pm and still no reply. worst customer service. I need my pictures!
