Eing held prisoner without any charge

My fiance was travelling with a taxi from diepsloot to Alexandra and he was a passenger in a taxi when a taxi driver hit a person on a motor bike and drove off without stopping so it was a hit and run so the police chased that taxi and got it so the police arrested the drive and the passengers which were in a taxi so my fiance spent a night in jail at dougladale police station he did nothing wrong he was passenger the worse part of it is that the polce who were on duty that night on 16 June 2013 used his cell phone airtime and the money in his wallet
I would understand if he is an alcoholic but he doesn't drink at all so I don't understand why he had to sleep in a holding cells with criminal
