Terrible Product and service to match

I purchased a new VW POLO VIVO GT, within 24 hours of purchase it was overheating, and this has happened on multiple occasions, VW say they have fixed the source of the problem but my issue is the resultant damage to the engine for overheating! in addition my car has been damaged during the multiple towing cases..
1. why cant VW SA give me a clear answer as to why the vehicle shouldn't be replaced.
2. why cant VW SA give me a confirmation as to how the vehicle was tested for any resultant damage.
3. why cant VW SA provide me with a clear answer as to who will foot the bill for the towing scratches on my car.

i have a faulty, damged product and terrible service to match!
