3rd party claim nightmare

I was bumped by their client, Mr Jantjies on 3 Sept 2013 while stationery. The cops were called (report nr: 15/09/2013) and their client got into an ambulance not taking any contact details or even a sorry. After more than a week the client never contacted me. I got his details from the police station. My husband called him. After almost two weeks of dodging us Mitch Jantjies eventually informed my husband he's insured with Mutual and agri brokers will assist. Firstly we were sent incorrect documents to complete. Then the horror started. Agri brokers informing us that we had to ensure that our car is insured then we wouldnt be speaking to them. Another week passed, my husband again had to contact them. Their response was that they advised their client not to speak to us and that they sent the quotes to Joburg and it was decided a cash settlement will be done. What the? More than a month has passed and my car is still not fixed. Not once has the company or Mitch Jantjies contacted us. Both parties are dodging us. Im now forced to take legal action against their client. What about "TCF" or have they never heard about the legislation that will be passed..I"m disgusted
