I have been waiting since the end of July 2013 for a Court date for an eviction hearing. I had the following e-mail from my lawyer this morning (02/10/2013): "We have been checking with the Durban Magistrates Court for the issue of the summons and the application on a weekly basis. The Clerk of the Court actually informed our article clerk yesterday of the reason for the non-issue of the summons is that 'they have run out of file covers and thus unable to issue summons'. Unfortunately our hands are tied and unless the Court issues the documents we are not able to proceed with this matter. An alternative is you could proceed out the High Court, which will be substantially more expensive."
Who will sort out the mess at the Durban Magistrates Court and the substantial backlog which have built up as a result of this incompetence? Things like this should not be allowed to happen in a civilized society!
