Confiscation of cell phone

On Friday the 18th October 2013 my daughters cellphone was confiscated by the school. Granted it is a school rule and she should have handed it in at the office as required by the rule. The phone was not returned at the end of the day and we were not informed by the school. I met the management of the school they cited the code of conduct allowing them to keep the phone until the end of the term and refused to return it before then.

When we enrolled our daughter in this school the code of conduct had no such wording. This wording has changed and during the course of this year, definitely since the 27 August 2013 when the coc was published on the school communicator, more likely on the 18th Oct when a note was published on the schools communicator. The school is trying to punish me as a parent as well as my child. They have also banned her from her grade 7 farewell, which is devastating for a 13 year old girl, for this infringement of the rules.

In a country such as ours I cannot see how this is allowed, the police say that they cannot do anything because it is a school rule and the intent is not to so technically it is not. I need help to resolve this.
