Octa Coal together with its Canadian funders are attempting to open a coal mine next to the old Anglo American Vierfontein Colliery on a ajoining farm called Groenfontein. The Rivergroup was approached by Octa Coal for corporate funding but Rivergroup ended up trying to highjack the project together with the other respondents. Octa entered into a NDNCA with the Rivergroup "River Capital Partners".

Octa Coal has signed agreements with the majority of the Groenfontein Collieries shareholders to aquire the project. There is a current mining right and a proven reserve. The short version is that the respondents attempted to circumvent Octa Coal and did so unlawfully and in contravention of the agreement.

The respondents further did not comply to the confidentiality agreement. They were interdicted on 07/08/2013 and a Anton Piller order granted for search and removal of documents in their possession. Their offices were entered by the Sheriif and computor experts and independent attorney Anton Rudman. All the proof was found on their computors. A final order was granted on 10/09/13. I will forward the final order in a separate email. As well as the affidavit in support thereof
