Mrs R. van Wyk (the client) and Mr Jacques Nienaber (the builder) came to a verbal agreement for erecting a building to my house for her (Mrs van Wyk) witch are my mother in law. After he gave as a Quotation for R294, 561.00 we told him we accept his offer and that he could start with the building. She then started paying the first money for the building of R192, 000.00 in November 2012, then he started with the building of foundation etc, and he mentioned that he had ordered all the material. During December he requested that he needed more money for material and she paid a second payment of R 36, 000.00 in to his account on 07 December 2012. He then stopped building during December 2012 and started in January 2013 he then requested for more money the third payment of R 6000.00 was also needed for material and was paid into his account on the 21 january 2013 to pay the suppliers. The workers went on building and then Mr Nienaber started mentioning that he must complete the work before end of February for he has another work waiting to be done in Richardts Bay and then every thing went wrong. No payment to workers no deliveries. She had to use all her savings to go on with building.
